Permission to use my image?

I didn't know whether to post this here or in the music section, but here it goes. Guitarist in my band decides to leave for personal reasons. He also decides to take the Name of the band with him, which is his right, he trademarked it. If he opts to start a new band under the same name, does he have the right to continue to use pictures of me on his website without my consent?
